Terms of Service

Welcome to Tekkers. These Terms of Service ("Terms") govern your use of the Tekkers mobile application and related services (collectively, the "Service") provided by Tekkers Inc. ("Tekkers," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

2.1 Age Requirements

  • 18 and older: May use the Service with full functionality
  • 13-17 years old: May use the Service with parental awareness; certain features require parental consent
  • Under 13: Not currently permitted without verified parental consent (coming soon)

2.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. The Service

3.1 Description

Tekkers provides soccer training tools including:

  • Strike Lab - video analysis of soccer techniques
  • Maestro - AI coaching feedback and drill recommendations
  • Progress tracking and milestone achievements
  • Subscription management for premium features

3.2 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when possible.

3.3 Accuracy of Analysis

Our AI analysis is for training and entertainment purposes. While we use real physics principles, results should not be considered professional coaching advice. Always train safely and consult qualified coaches for serious athletic development.

4. User Content

4.1 Your Content

You retain ownership of videos and content you upload ("User Content"). By uploading, you grant Tekkers a worldwide, non-exclusive, royalty-free license to:

  • Process and analyze your content to provide the Service
  • Store your content on our servers
  • Create derivative works (analysis, metrics) from your content
  • Use anonymized/aggregated data to improve our AI models

4.2 Content Guidelines

You agree not to upload content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains malware or malicious code
  • Depicts individuals without their consent (except yourself)
  • Is not related to soccer training or athletics

4.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

5. Subscriptions and Payments

5.1 Free Tier

The free tier includes limited strike analyses per month. Free features may change at our discretion.

5.2 Pro Subscription

Pro subscriptions provide unlimited analyses and additional features. Subscriptions:

  • Auto-renew unless cancelled before renewal date
  • Are billed through your App Store or Play Store account
  • Can be managed in your device's subscription settings

5.3 Refunds

Refund requests are handled by Apple App Store or Google Play Store per their policies. We do not process refunds directly.

5.4 Price Changes

We may change subscription prices with 30 days notice. Price changes apply at your next renewal period.

6. Intellectual Property

6.1 Our Property

The Service, including software, algorithms, designs, trademarks, and content created by Tekkers, is our exclusive property protected by intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, or distribute our software or content
  • Reverse engineer, decompile, or disassemble the app
  • Use the Service for commercial purposes without permission
  • Scrape, crawl, or data mine the Service
  • Circumvent security measures or usage limits

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Analysis results will be accurate or complete
  • The Service will meet your specific requirements
  • Any defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEKKERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tekkers and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

11. Termination

11.1 By You

You may terminate your account at any time through Settings > Account > Delete Account or by contacting support@tekkers.io.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice when possible.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (IP rights, limitation of liability, indemnification) will survive termination.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, please contact us at legal@tekkers.io to attempt informal resolution.

12.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.

12.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR REPRESENTATIVE PROCEEDINGS.

12.4 Small Claims Exception

Either party may bring qualifying claims in small claims court.

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

13.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tekkers regarding the Service.

13.3 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

13.4 Waiver

Our failure to enforce any right does not waive our right to enforce it later.

13.5 Assignment

You may not assign these Terms. We may assign our rights to any successor in interest.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
